Non Payment (Georgia)

Late Payment of Rent Instructions:

On the top lines enter the Landlord’s name and address.

On the lines that indicate Tenant’s name and address of premises, fill those out.

On the Notice to line write in the Tenant’s name as it appears on the Lease.

In the first paragraph enter the date that the underlying lease was signed. Then enter the address of the leased premises, make sure to indicate any apartment number or floor number.

In the second paragraph fill out the rent information. In the first blank enter the monthly rent amount.  In the next blank line enter the total amount of rents due and owing. For example, if the rent is $1,000 and the tenant has not paid rent for three months enter $3,000. In the following blank line enter the amount of late fees and charges due to the late payments. Then enter the due date of the amount and for which months the rent was due. For example, June, July and August of 2021.

In the next paragraph indicate the total amount that is due, this includes any rent payment due plus any late fees and charges.

In the fourth paragraph enter how many days from receipt of this notice the tenant has to pay the total amount due. This may be indicated in the lease terms, however it is best to check your local laws as every jurisdiction varies.

In the following sentence indicate how you want the tenant to pay the amount due, is it by check, cash, money order, or some other payment method. Indicate that on the blank after the words: Payment is to be made by ______, and then indicate the address where the tenant should drop off the payment.

On the second page enter the state that the premises are located in.

Then enter the date that this notice is signed and sent. Enter the date as day, month and then year.

The landlord should then print their name and address and then sign.

We have also included a proof of service, indicating how the notice was served upon the tenant. This proof of service should be notarized and kept by the landlord as proof.
