Cease and Desist Letter for Trademark Infringement Instructions:

On the top enter your name and address, next enter the recipient’s name and address. If there is a business name or corporation name enter that first, then enter the individual's name, followed by the address.

In the next line enter the date of the letter.

On the Dear line enter the name of the person to whom the letter is being addressed to.

In the First Paragraph of the letter, first describe your term or mark. Next enter the infringing term or mark and how its being used, for example is it on a product or name of a store front? Then in the last line of the first paragraph enter what jurisdictions or states the infringing term or mark is being used in.

In the second paragraph enter your term or mark and how you use it in, and for how long you have been using it. In the second sentence, enter the name of the agency with which you have registered your mark or term and then enter the registration numbers, respectively.

In the third paragraph enter where you use, advertise and/or promote your Mark. For example, is it nationwide, statewide or through out several states such as, “throughout New York, California, Western Pennsylvania, and Maryland."

In the fourth paragraph describe the effect the use of the term or mark by the infringing party has had on your business and on your Mark. For example, has it caused confusion or deception or mistake, or a combination of these among your customers?

In the fifth paragraph specify where the infringing party is using the term or the mark. For example, is it on their similar business or product?

Then sign the letter and mail it to the infringing party. It is best to send the letter via certified mail, return receipt requested, this way you will have proof of mailing.
